Terms & Conditions

Article 1 – Definitions

For the purposes of these terms:

  • Withdrawal Period – the period in which the consumer may exercise the right of withdrawal from the contract;

  • Consumer – a natural person not acting in the course of a profession or business who enters into a distance contract with the entrepreneur;

  • Day – a calendar day;

  • Ongoing Transaction – a distance contract concerning a series of products and/or services, where the obligation of delivery and/or receipt is spread over time;

  • Durable Medium – any tool that enables the consumer to store information addressed to them personally in a way that allows future access and unchanged reproduction of the information;

  • Right of Withdrawal – the option for the consumer to withdraw from the distance contract within the withdrawal period;

  • Entrepreneur – a natural or legal person offering products and/or services to consumers at a distance;

  • Distance Contract – a contract concluded within an organized system for distance selling, using only distance communication methods;

  • Means of Distance Communication – a method that enables concluding a contract without the simultaneous physical presence of the consumer and the entrepreneur;

  • General Terms – these general terms and conditions of the entrepreneur.

Article 3 – Applicability

These general terms apply to every offer by the entrepreneur and every distance contract or order between the entrepreneur and the consumer.

Before concluding a distance contract, the consumer will receive these general terms. If this is not reasonably possible, the entrepreneur will indicate where the terms can be viewed and will send them free of charge upon request.

If the contract is concluded electronically, the general terms may be provided in a way that allows for durable storage. If this is not possible, the entrepreneur will indicate where they can be accessed electronically and will send them free of charge upon request.

If specific product or service conditions apply, they take precedence over these general terms in the case of conflict.

If one or more provisions are found to be invalid, the remaining provisions remain in effect, and the invalid provision is replaced by one that closely matches the original intent.

Situations not covered by these terms will be assessed in the spirit of the terms. Ambiguities will be interpreted accordingly.

Article 4 – Offer

If an offer has a limited duration or is subject to conditions, this will be clearly stated.

Offers are non-binding. The entrepreneur reserves the right to modify or adjust them.

Offers contain a complete and accurate description of the products and/or services. The description is sufficiently detailed to allow a proper evaluation. If images are used, they represent the products and/or services as accurately as possible. Obvious errors are not binding.

All images and specifications are for illustrative purposes and do not give grounds for claims or contract cancellation.

Product images reflect the offered items as faithfully as possible, but exact color matching cannot be guaranteed.

Each offer contains information so that the consumer is aware of their rights and obligations, particularly:

  • price including taxes;

  • shipping costs;

  • how the contract will be concluded and the steps involved;

  • whether the right of withdrawal applies;

  • accepted payment, delivery, and execution methods;

  • validity period of the offer or price guarantee;

  • cost of using distance communication, if not based on standard rates;

  • whether the contract will be archived and how it can be accessed by the consumer;

  • how the consumer can review and correct input before finalizing the contract;

  • available languages besides Dutch;

  • any applicable codes of conduct and how they can be reviewed;

  • minimum contract duration in the case of ongoing contracts;

  • available sizes, colors, and material options.

Article 5 – Contract

The contract is concluded when the consumer accepts the offer and meets the stated conditions, subject to paragraph 4.

If the consumer accepts the offer electronically, the entrepreneur will confirm receipt promptly. Until confirmation is received, the consumer may cancel the agreement.

If the contract is concluded electronically, the entrepreneur takes technical and organizational measures to secure data transmission and online environments. Appropriate security measures are used for online payments.

The entrepreneur may assess whether the consumer can meet their payment obligations and check other relevant factors. If justified, the entrepreneur may decline the order or set special conditions.

Upon delivery of the product/service, the entrepreneur will provide the following (on a durable medium):

A. Contact address for complaints;
B. Conditions and method for exercising the right of withdrawal, or a statement if it does not apply;
C. Information about after-sales service and warranties;
D. The information listed in Article 4(3), unless already provided;
E. Terms for terminating the agreement in case of an indefinite or extended contract.

For ongoing transactions, this applies only to the first delivery.

Contracts are subject to product availability.

Article 6 – Right of Withdrawal

When purchasing products, consumers may cancel the agreement within 14 days without giving a reason. The period starts the day after the consumer or an authorized third party receives the product.

During this period, the consumer shall handle the product and packaging with care and use it only as necessary to assess it. If exercising the right of withdrawal, the product should be returned in its original state and packaging, if reasonably possible, following the entrepreneur’s instructions.

The consumer must inform the entrepreneur in writing or electronically within 14 days of receiving the product. After that, they have another 14 days to return it. Proof of shipment should be provided.

If the consumer does not exercise the right of withdrawal within the given periods, the contract remains binding.

Article 7 – Return Costs

In the case of withdrawal, the consumer bears the direct return costs.

The entrepreneur will reimburse the purchase price, including initial shipping fees, within 14 days of withdrawal, provided the product is returned or proof of return is submitted.

Article 8 – Exclusion of Right of Withdrawal

The entrepreneur may exclude the right of withdrawal for certain products or services, provided this is clearly stated in the offer or before contract conclusion.

Exclusion applies only to:

Products:

A. made to the consumer's specifications;
B. clearly personal in nature;
C. not suitable for return due to their nature;
D. perishable or quickly expiring;
E. with price dependent on financial market fluctuations beyond the entrepreneur’s control;
F. newspapers and magazines;
G. audio/video recordings or software with broken seals;
H. hygiene products with broken seals.

Services:

A. involving accommodation, transport, catering, or leisure for a specific date;
B. begun before the withdrawal period ends, with the consumer’s explicit consent;
C. related to betting and lotteries.

Article 9 – Price

During the validity period of the offer, prices will not be increased, except for changes in VAT rates.

For products/services with fluctuating market prices, this will be indicated in the offer.

Price increases within 3 months of contract conclusion are only allowed due to legal changes. After that, the consumer may terminate the contract.

All prices include VAT. The entrepreneur is not obliged to honor prices that are clearly incorrect.

Article 10 – Compliance and Warranty

The entrepreneur ensures that the products/services conform to the contract, offer specifications, quality and usability standards, and legal requirements.

Defects or non-conformities must be reported within 14 days of receipt. Items should be returned in original packaging and unused condition.

Warranty duration is in accordance with the manufacturer’s warranty. The entrepreneur is not liable for misuse or consequences of product use.

Warranty does not apply if:

  • the consumer has made repairs/modifications;

  • the product was used contrary to instructions;

  • the defect is due to external causes or normal wear and tear.

Article 11 – Delivery and Execution

The entrepreneur exercises the utmost care in order execution.

Delivery occurs at the address provided by the consumer.

Orders are fulfilled promptly, within a maximum of 30 days unless otherwise agreed. In case of delay, the consumer will be informed and may cancel the contract at no cost.

Upon cancellation, the entrepreneur refunds the amount paid within 14 days.

If fulfillment is impossible, a replacement product may be offered. The right of withdrawal still applies, and return costs are borne by the entrepreneur.

Risk of damage or loss remains with the entrepreneur until the product is delivered to the consumer or authorized third party.

Article 12 – Ongoing Contracts: Termination and Extension

Termination
Consumers may cancel an indefinite contract at any time with one month’s notice.
Fixed-term contracts may be cancelled at the end of the term with one month’s notice.

Extension
Fixed-term contracts may not be automatically extended.
Exception: newspaper/magazine subscriptions may be extended by up to 3 months, with one month cancellation notice.
A fixed-term contract may convert to an indefinite one, provided the consumer may cancel with one month’s notice.

Duration
For contracts longer than one year, consumers may cancel at any time after one year, with one month’s notice.

Article 13 – Payment

Unless agreed otherwise, the consumer must pay within 7 days from the start of the withdrawal period (Article 6.1). For services, the period begins upon receiving confirmation.

Consumers must promptly report any errors in payment data.

In case of late payment, the entrepreneur may charge legally permitted costs.

Article 14 – Complaints

Complaints about contract execution must be reported clearly within 7 days of discovering the issue.

The entrepreneur will respond within 14 days. If more time is needed, the consumer will receive an acknowledgment with an estimated resolution date.

If a complaint cannot be resolved amicably, mediation or other dispute resolution methods may be used.

Filing a complaint does not suspend the entrepreneur’s obligations unless otherwise stated in writing.

If the complaint is justified, the entrepreneur may repair or replace the item free of charge.

Article 15 – Governing Law

These general terms are governed exclusively by Dutch law, even if the consumer resides abroad.

Article 16 – Import Duties and VAT

The customer is responsible for paying any applicable import duties and VAT upon receipt of goods.

Article 17 – Delivery and Shipping

Goods are shipped directly from a third country. The seller does not handle the import procedure.

Article 18 – Risk of Delays or Additional Costs

Delays or extra costs (e.g., customs processing fees) may occur during import and are the sole responsibility of the customer.
